In Santa Ana, prosecutors say that the man who was charged with murder and a driving under the influence accident that killed Los Angeles pitcher Nick Adenhart and two others spent hours drinking tequila and beer at three bars before stepping behind the wheel.
Prosecutors say that 23-year-old Andrew Gallo knew of the dangers of drunk driving because he was convicted of DUI in 2006 and signed court papers that indicated he understood that if he killed someone while driving under the influence he could be charged with murder. This was revealed to jurors during an opening statement made by Deputy District Attorney Susan Price.
She said, "The evidence will show that this case is about an evening of pure indulgence and a night of total disregard."
Gallo has pled guilty to three counts of second degree murder for the deaths of Adenhart as well as a 20-year-old and a 25-year-old. He also pled not guilty to felony hit-and-run and two counts of DUI causing injury.
Police say that at the time of his arrest, Gallo's blood-alcohol level was three times the legal limit. If he is convicted, he could face more than 50 years to life in prison.
