Last Defendant Sentenced in $15 Million Medicare Fraud Case

This week, the last defendant involved in a major Medicare fraud scheme was sentenced. For six years, legal proceedings were carried out by federal authorities who initially discovered the $15 million scam.
The defendant, Xinming Fu, is a 48 year old Irvine physician. Fu was sentenced to 30 months in federal prison. He was also ordered to pay $390,000 in restitution after pleading guilty to paying kickbacks and charges of health care fraud.
According to the U.S. attorney's office, patients that were living in board and care facilities were given unnecessary respiratory tests. Doctors would give their patients, soda, candy and cigarettes and then keep Medicare payments. The people that owned the facilities then received kickbacks.
