Man Charged with Murdering His Grandmother

James Masterson of Riverbank, California faces serious charges including themurder of his grandmother. The 22-year-old is accused of stealing his grandmother's credit cards and car, and burying her body in her flower garden. His grandmother, Peggy Herlacher, was found strangled and buried in the backyard flower garden by local authorities; she had been reported missing on July 24.
Although Lyon County prosecutors attempted to wrangle a deal with Masterson, he declined the offer to plead guilty to second-degree murder with an elderly enhancement. Now a court date has been set instead for the preliminary hearing to be held on March 2 - 3 at the Walker River Justice Court. At that time the judge will determine if there is enough evidence to try Masterson on the murder and robbery charges.
